Both adoption and surrogacy law involve highly charged emotional and legal issues. Family law attorneys who handle adoptions and/or surrogacy contracts generally see a range of clients, including adopting parents, birth parents, intended parents, surrogates, gestational carriers and egg donors.

Adoption is a legalized way of forming a family. There are approximately 120,000 adoptions each year in the United States, and slightly more than half of them are related adoptions – meaning the adoptive parent or parents are a blood relation or stepparent of the child. The rest are unrelated adoptions.

Most adoptions can be categorized into three basic types:

1. Domestic, private adoption. These are also known as parental placement or direct placement adoptions, and most commonly involve people related by blood, or stepparents. In these adoptions, the birth parents select the adopting parents. Some states require that an official meeting take place between both parties. The exchange of background information is standard in such placements. Written consent is usually required in this type of adoption arrangement.
2. Agency adoption. In this type of arrangement, the birth parent or parents usually do not meet with or select the adopting parent or parents. Instead, the birth parent enters into an entrustment agreement with the agency, and the agency decides with whom the child will be placed. In some states, the biological parents are allowed to select and meet the adopting parents.
3. International adoption. Between 12,000 and 15,000 foreign-born children are adopted by U.S. residents each year. The cost of international adoption can vary greatly, depending on the country where you choose to adopt, the child’s circumstances, travel costs, etc. International adoptions are often done by agencies, and most children available for adoption in other countries already are in orphanages or foster care, and the rights of the biological parent or parents have already been terminated.

All adoptions, whether private or independent, must be handled by the court. Due to the complexity of local court procedures, it is best to engage an experienced attorney.

Surrogacy is available to both couples and individuals, regardless of where they live and the laws of the state in which they live. Under a surrogacy arrangement, a woman agrees to bear a child for another couple, with or without payments. In most cases, the husband’s sperm is used to fertilize an egg of the wife, or the surrogate mother, making the husband the biological father of the child. The surrogate mother agrees to give up all parental rights at birth, and the wife legally adopts the child.

There are two basic medical procedures hopeful parents consider when arranging surrogacy:

• Use of a true surrogate (carries the child and contributes her own egg); or
• Use of a gestational carrier (carries the child and uses the intended mother's eggs or donor eggs)

Either donor sperm or sperm from the intended father is used to fertilize the egg.

It is important that people entering surrogacy agreements protect themselves with competent and experienced legal representation. Portions of surrogacy agreements may not be legal in all states. For example, a few states outlaw or restrict such arrangements when the surrogate mother receives payment. Other states also might give the surrogate mother the right to keep the child after birth.
